| Abstract | ||
| مما لا شك فيه أن الجريمة لا ترتكب من شخص عادي بل شخص لديه خبرة ودراية بالأعمال الطبية، ويملك قدراً كبيراً من الذكاء والمعرفة ويكون قادراً على وضع تراكيب للأدوية والمستحضرات الطبية تختلف عما هو موجود في الدواء الأصلي، وهذا ما دفع المشرع إلى إيجاد حماية جنائية تنسجم مع تلك الجريمة والأخذ بمعيار الخطورة الإجرامية لمرتكب هذه الجريمة، وتعتبر جهة الاستدلال والتحري للجرائم الناتجة عن التصنيع الدوائي من الجهات الأساسية في مكافحة الجرائم المتعلقة بالأدوية، حيث يتولى مأموري الضبط القضائي مسئوليات تتعلق بجمع الأدلة والمعلومات اللازمة، وتشتمل هذه المرحلة بمراجعة الوثائق ذات الصلة والقيام بتحقيقات ميدانية، وأخذ بعض العينات لتحيليها وضبطها مما يسهم في بناء صورة شاملة عن الجرائم المرتكبة، كما يتمتع مأموري الضبط القضائي بصلاحية الرقابة والتفتيش على المنشآت الصيدلانية والمرافق الصحية، كما يقوم مأموري الضبط القضائي بتحرير محاضر رسمية توثق فيها كافة الإجراءات بما في ذلك جمع الأدلة وضبط المخالفات، كما يتخذوا جميع التدابير اللازمة للحفاظ على هذه الأدلة مما يعكس أهمية دورهم في تعزيز النظام القانوني وحماية الصحة العامة. Abstract: There is no doubt that the crime is not committed by an ordinary person, but rather a person who has experience and knowledge of medical work, and has a great deal of intelligence and knowledge and is able to develop compositions for medicines and medical preparations that differ from what is found in the original medicine, and this is what prompted the legislator to find criminal protection consistent with that crime and the adoption of the criterion of criminal seriousness for the perpetrator of this crime The inference and investigation body for crimes resulting from pharmaceutical manufacturing is one of the main authorities in combating drug-related crimes, where judicial officers have responsibilities related to collecting the necessary evidence and information, and this stage includes reviewing relevant documents, conducting field investigations, and taking some samples for referral and seizure, which contributes to building a comprehensive picture of the crimes committed, and judicial officers have the authority to monitor and inspect pharmaceutical facilities and health facilities, and judicial officers edit official records. They document all procedures, including collecting evidence and detecting violations, and take all necessary measures to preserve this evidence, which reflects the importance of their role in strengthening the legal system and protecting public health. | ||
