| Abstract | ||
| لقد بينت الدراسة أن الأجور هي الهدف الرئيس الذي يغترب من أجله العامل المهاجر، فلولاه ما كان يغترب العامل، لذلك، بينت الدراسة أنه يجب أن تُكفل للأجر سبل الحماية التي تحقق هذا الهدف المرجو من عملية الهجرة، وذلك يتحقق من عدة محاور تتمثل في: ضرورة حماية ما يتقاضاه العامل المهاجر من أجور وعدم المساب بها، ويتحقق ذلك بضمان حماية هذه الأجور، ويتحقق ذلك بضمان حد أدنى للأجور، وأخيرًا من خلال اتباع العدالة – قد المستطاع- في توزيع الأجور وعدم النص على فوارق مجحفة في الأجور بين العمال المهاجرين أنفسهم من جهة، وبين العمال المهاجرين والمواطنين من جهة أخرى، ويتحقق ذلك بضمان عدم التمييز والمساواة في الأجور. كما بينت الدراسة أن الحق في الصحة، يعتبر من الحقوق الأساسية للإنسان، فهو حق للجميع، وأن الحق في الصحة المهنية جزء لا يتجزأ من الحق في الصحة، فظروف العمل الملائمة تقتضي مراعاة السلامة والصحة في العمل، وهي تشكل أساس سلامة العامل أثناء أداءه للعمل. Abstract: The study showed that wages are the main goal for which the migrant worker is abroad, without which the worker would not have been abroad, therefore, the study showed that the wage must be guaranteed the means of protection that achieve this desired goal of the migration process, and this is achieved from several axes: The need to protect the wages received by the migrant worker and not to suffer from them, and this is achieved by ensuring the protection of these wages, and this is achieved by ensuring a minimum wage, and finally by following justice. It is possible - in the distribution of wages and the absence of unfair wage differentials between migrant workers themselves on the one hand, and between migrant workers and citizens on the other, and this is achieved by ensuring non-discrimination and equal pay. The study also showed that the right to health is one of the basic human rights, as it is a right for all, and that the right to occupational health is an integral part of the right to health. | ||
