| Abstract | ||
| قد أخبر سبحانه أنه أحكم كتابه؛ فلا يصل إليه الاختلاف والاضطراب، ولا تتناقض أحكامه ، كما أخبر سبحانه أنه أرسل رسله بالبينات ، وأنزل معهم الكتاب والميزان، والميزان هو العدل، وهو الجمع بين المتماثلات، والتفريق بين المختلفات. كما وصف كتابه بالإحكام العام، وصفه بالتشابه العام؛ ثم أنه جعل منه آيات محكمات، وأخر متشابهات ؛وكل ذلك حق لا تعارض فيه ولا تناقض؛ إذ لكل واحد من هذه الأوصاف معنى يناسبه، لا يناقض الآخر، ولا يعارضه. وإذا كانت الشريعة كذلك فإنها لا شك خالية من التعارض والتضارب في نصوصها وأحكامها؛ لكن لماذا نجد علماء الأصول يعنون ببحث التعارض والترجيح بين أدلة الأحكام الشرعية؟ الجواب: أن الباحث قد يجد بعض النصوص التي ظاهر بعضها يعارض البعض الآخر أو يغايره فيظن أن هناك تعارض بينهما لكن إذا أمعن النظر فيها وجد أنه لا تعارض بينهما على الحقيقة. Allah the Almighty has informed us that He has perfected His Book; so that disagreement and confusion do not reach it, and His rulings do not contradict, as He the Almighty has informed us that He sent His Messengers with clear proofs, and sent down with them the Book and the Balance, and the Balance is justice, and it is the combination of similarities, and the differentiation between differences. As He described His Book with general rulings, He described it with general similarity; then He made from it clear verses, and others ambiguous; and all of that is true, there is no conflict or contradiction in it; as each one of these descriptions has a meaning that suits it, does not contradict the other, nor oppose it. If the Sharia is like this, then there is no doubt that it is free from conflict and contradiction in its texts and rulings; but why do we find scholars of Usul concerned with researching conflict and preference between the evidence of the Sharia rulings? Answer: The researcher may find some texts that appear to contradict or differ from each other, so he thinks that there is a contradiction between them, but if he looks closely at them, he will find that there is no contradiction between them in reality. | ||
