| Abstract | ||
| يبرم الحجاج سنويا عددا كبيرا من العقود مع متعهدي تقديم خدمات الحج، أذ يبلغ عدد هذه العقود بضعة ملايين، ويترتب على إبرامها التزامات متبادلة بين طرفيها، متعهد رحلة الحج من جهة، والحاج من جهة أخرى، ويتناول هذا البحث التزامات المترتبة على الحاج بموجب العقد المبرم مع متعهد رحلة الحج التي تعاقد معها، ولعل من أهمها: التزامه بدفع المقابل المالي، والتزامه بالتقيد بالتعليمات والتوجيهات المحددة في العقد، غير أن بعض بنود هذه العقود قد يكون فضفاضا بحيث يشمل أمورا كثيرة قد لا تخطر ببال الحاج عند إبرامه للعقد، خصوصا وأنه في كثير من الأحيان لا يمتلك المعلومات والخبرة التي تمكنه من إدراك جانب من تفاصيل تلك العقود، وعلى خلاف متعهد رحلة الحج الذي تمتلك الإمكانيات والخبرات الواسعة في هذا الصدد، لذلك أتت هذه الدراسة لتلقى الضوء على الالتزامات المترتبة على الحاج في مواجهة متعهد رحلة الحج، وقد توصلت الدراسة إلى نتيجة مفادها توزع القواعد الحاكمة لعقد رحلة الحج على شريحة غير قليلة من الأنظمة واللوائح والتعليمات والأليات والضوابط والنماذج والوثائق، كما توصلت إلى توصية رئيسة مفادها ضرورة إصدار نظام خاص بتنظيم شون الحج كافة، كتلك المتعلقة بعقد رحلة الحج والالتزامات الناجمة عنه، ولا سيما الالتزامات الواقعة على عاتق الحاج. Pilgrims conclude annually a large number of contracts with companies specialized in providing Hajj and Umrah services, as the number of these contracts reaches a few million, as these contracts arrange mutual obligations between their two parties, the Hajj companies on the one hand, and the pilgrims on the other hand. This research deals with the obligations of the pilgrims under the contract concluded with the Hajj company with which they contracted, perhaps the most important of which are: their commitment to pay the financial compensation, and their commitment to adhere to the instructions and directives specified in the contract. However, some of the clauses of these contracts may be loose enough to include many things that may not occur to the pilgrims when they conclude the contract, especially since they often do not possess the information and experience that would enable them to perceive part of the details of those contracts, unlike Hajj companies that have the capabilities and expertise. In this regard, this study came to highlight the obligations of the pilgrim in the face of the pilgrim companies. | ||
