| Abstract | ||
| المخلص: تعتبر نفقة الطفل من الواجبات التي فرضها الله على المنفِق، ومن القضايا التي ترفع فيها الدعاوى إلى محاكم الأحوال الشخصية (دعوى زيادة نفقة أو إنقاصها) إذ إن القاضي قد يحكم بتقدير النفقة بناء على حال المنفِق سعة وضيقا، وقد يتغير حال المنفِق للأفضل أو يتغير للأقل أو تتغير أحوال المنفَق عليه، ومن هنا تبرز المشكلة التي يعالجها البحث وتثور عدة تساؤلات: هل يحق للمنفَق عليه أن يطلب زيادة النفقة في حال تغيرت الأوصاف والأحوال؟ وفي المقابل هل يحق للمنفِق أن يطلب تخفيض النفقة للأقل في حال ضعف دخله وتغير حاله للأقل؟ وما هي الضوابط لذلك؟ وما هي سلطة المحكمة في ذلك؟ فجاء هذا البحث موسوما بعنوان: (أثر تغيّر الأحوال والأوصاف في دعوى زيادة أو إنقاص نفقة الطفل المحضون -دراسة تأصيلية تطبيقية في المحاكم السعودية) وسوف يكون نطاق البحث في نظام الأحوال الشخصية في المملكة العربية السعودية الصادر عام 1443 هـ وفي التطبيقات القضائية الصادرة من محاكم الأحوال الشخصية بعد صدور النظام، وسوف يكون نطاق البحث في نفقة الطفل وفي تغير حال المنفِق والمنفَق وسوف يكون البحث في الزيادة والإنقاص دون الإلغاء ومن أهم أهداف البحث التي يبرزها الباحث بيان أثر تغير حال المنفِق والمنفَق عليه في مراجعة تقدير النفقة، وبيان سلطة القاضي في ذلك، وبيان التطبيق القضائي العملي، وسوف يقوم الباحث باستخدام المنهج الوصفي الاستقرائي والتطبيقي للوصول إلى فكرة البحث وأهدافه، ويعتقد الباحث أن من أهم نتائج البحث: بيان منزلة الفقه الإسلامي في معالجة النوازل والمستجدات، واهتمام القضاء بقضايا النفقة لارتباطها بالضرورات التي جاءت الشريعة بحفظها ومنها: حفظ النفس وحفظ المال، ومن أهم التوصيات التي يقترحها الباحث: دراسة جوانب التغيير التي تطرأ على حال المنفَق عليهم في مراجعة تقدير النفقة، مثل: أن تتزوج الفتاة المنفق عليها أو يتوظف الابن المنفق عليه، كما يوصي أيضا بدراسة إجراءات دعوى الأحوال الشخصية المتنوعة وإبرازها. Abstract Child Alimony is one of the duties imposed by Allah on the who pays the alimony، and one of the cases in which lawsuits are brought before the family courts is (a lawsuit to increase or decrease Alimony)، as the judge may rule to estimate the Alimony based who pays the alimony whether it is easy or difficult، and the who pays the alimony may change for the better or for the less، or the circumstances of the person being supported may change. Hence، the problem addressed by the research arises and several questions arise: Does the person being supported have the right to request an increase in support if the descriptions and circumstances change? Conversely، does the provider have the right to request a reduction in support to a lesser amount if his income is weak and his situation changes for a lesser amount? What are the controls for that? What is the court's authority in this regard? This research came under the title: (The effect of changing conditions and descriptions in the lawsuit to increase or decrease the maintenance of the child in custody - an original applied study in Saudi courts). The scope of the research will be in the family courts Law in the Kingdom of Saudi Arabia issued in 1443 AH and in the judicial applications issued by the family Courts after the issuance of the law. The scope of the research will be in the Child Alimony and in the change in the condition of the spender and the spent. The research will be in the increase and decrease without cancellation. Among the most important objectives of the research that the researcher highlights is to clarify the effect of changing the condition of the spender and the spent on in reviewing the maintenance estimate، clarifying the judge’s authority in this، and clarifying the practical judicial application. The researcher will use the descriptive، inductive and applied approach to reach the idea of the research and its objectives. The researcher believes that among the most important results of the research: clarifying the status of Islamic feqh in dealing with new developments and issues، and the judiciary’s interest in maintenance issues due to their connection to the necessities that the Sharia came to preserve، including: preserving life and preserving money. Among the most important recommendations proposed by the researcher: studying the aspects of change that The situation of those being Alimony is affected when reviewing the alimony assessment، such as: the girl being supported gets married or the son being supported gets a job. It is also recommended to study and highlight the various family courts procedures. | ||
