| Abstract | ||
| أن نظرية الوضع الظاهر تلعب دورًا جوهريًا في إرساء النموذج القانوني للجريمة، وذلك من خلال تحليل تأثيرها على المسؤولية الجنائية وإمكانية تطبيقها كسبب لانتفاء القصد الجنائي أو تخفيف العقوبة. حيث تساهم في تحقيق التوازن بين مبدأ الشرعية الجنائية وحماية الأفراد الذين يعتمدون على مظاهر قانونية مشروعة. فمن خلال تحليلها، يتبين أن هذه النظرية يمكن أن تؤثر على تكييف المسؤولية الجنائية، إما بنفي القصد الجنائي أو بالتخفيف من العقوبة، وفقًا لظروف كل حالة على حدة. وتستند هذه النظرية إلى فكرة أن الشخص الذي يتصرف بناءً على مظهر قانوني مشروع لا يمكن تحميله المسؤولية الجنائية الكاملة، طالما لم يكن هناك خطأ جسيم في تقديره للواقع. إن الاعتراف القانوني بالوضع الظاهر يساعد في تحقيق العدالة، ليس فقط من خلال ضمان عدم معاقبة الأفراد الذين تصرفوا بحسن نية، ولكن أيضًا من خلال تعزيز الثقة في المنظومة القانونية، بحيث لا يتحمل الأشخاص تبعات قانونية لخطأ لم يكن في وسعهم إدراكه. وعلى هذا الأساس، يظل الوضع الظاهر أحد المفاهيم القانونية التي تستدعي مزيدًا من البحث والتطوير، خاصةً مع تطور الجرائم الحديثة وتعقيداتها، بما في ذلك الجرائم الإلكترونية والاقتصادية. Research Summary: The theory of the apparent situation plays an essential role in establishing the legal model of crime, by analyzing its impact on criminal responsibility and its applicability as a reason for the absence of criminal intent or mitigation of punishment. It contributes to striking a balance between the principle of criminal legality and the protection of individuals who rely on legitimate legal manifestations. Through its analysis, it is clear that this theory can influence the adaptation of criminal liability, either by denying criminal intent or by mitigating the penalty, according to the circumstances of each individual case.This theory is based on the idea that a person acting on a lawful legal appearance cannot be held fully criminally responsible, as long as there is no gross error in his assessment of reality. Legal recognition of the prima facie situation helps deliver justice, not only by ensuring that individuals who act in good faith are not punished, but also by strengthening trust in the legal system, so that people do not bear legal consequences for a mistake they could not have comprehended. On this basis, the apparent situation remains one of the legal concepts that require further research and development, especially with the development and complexity of modern crimes, including cybercrime and economic crime. | ||
