| Abstract | ||
| تعد العقوبة المالية من القضايا التي لم يرد فيها نص من القرآن أو السنة بإجازتها أو منعها، وقد تنازعتها قواعد عامة وأدلة جزئية بين مبيح ومانع، واختلف العلماء في حكمها، حتى قال العلمي: "أما العقوبة بالمال فقد طال بحثي عنها وما عثرت على غاية المطلوب منها". وهذا البحث فيه رصد لأقوال علماء المذهب المالكي ونصوصهم منذ تأسيسه على يد الإمام مالك بن أنس إلى القرن الرابع عشر الهجري، وقد قسمت البحث إلى تمهيد وفيه عرفت بمفردات العنوان، وأربعة مباحث، الأول منها للعقوبة المالية في مرحلة تأسيس المذهب، والمبحث الثاني: للعقوبة المالية في مرحلة تقعيد أصول المذهب وتأصيل مسائله، والثالث: للعقوبة المالية في مرحلة استقرار المذهب، والمبحث الرابع لدراسة المسألة المشهورة عند المتأخرين من المالكية بالمغرم أو عقوبة الخطأ. وقد تطورت هذه المسألة عبر القرون، إذ اقتصر كلام إمام المذهب وتلاميذه على العقوبة في المال وهو المعروف في أيامنا بالمصادرة مع منعهم إتلاف المال، وقصر العقوبة فيه على إعطائه لمن ينتفع به، وفي المرحلة الثانية لم يختلف الحال عن المرحلة الأولى، إذ اقتصر كلامهم على العقوبة في المال مع إجازة بعض القضاة والمفتين من أهل الأندلس إتلاف المال محل الجناية وإحراقه، وفي المقابل انتصر بعضهم لمنع العقوبة المالية مطلقا مع دعوى الإجماع على ذلك. وفي المرحلة الثالثة تميز مصطلحان عند فقهاء المذهب: العقوبة بالمال وهو ما يقابل الغرامة المالية في أيامنا، والعقوبة في المال ويقابلها مصادرة المال، وتبين أن أكثر علماء المذهب على منع العقوبة بالمال حتى ظهرت فتوى البرزلي في القرن التاسع الهجري بإجازتها، وإجازة فرض الغرامات المالية عند تعذر إقامة الحدود الشرعية، وقد لقي كلامه هذا قبولا عند بعض فقهاء المغرب وموريتانيا في القرون المتأخرة وجرى به عملهم Financial punishment is one of the issues in which there is no text in the Qur’an or Sunnah permitting or prohibiting it, and it has been disputed by general rules and partial evidence between those who permit and those who prohibit, and scholars differed in its ruling, until Al-Ilmi said: "As for the punishment with money, my research on it has been long and I have not found the ultimate goal required of it." This research includes a review of the statements of the scholars of the Maliki school of thought and their texts since its establishment by Imam Malik bin Anas until the fourteenth century AH, and I have divided the research into an introduction in which I have identified the terms of the title, and four chapters, the first of which is for financial punishment in the stage of establishing the school of thought, the second chapter: for financial punishment in the stage of establishing the principles of the school of thought and establishing its issues, the third: for financial punishment in the stage of stabilizing the school of thought, and the fourth chapter is to study the issue known among the late Malikis as the fine or the penalty for error. This issue has developed over the centuries, as the speech of the Imam of the school and his students was limited to the punishment in money, which is known today as confiscation, while they prohibited the destruction of money, and limited the punishment to giving it to those who benefit from it. In the second stage, the situation was no different from the first stage, as their speech was limited to the punishment in money, with some judges and muftis from Andalusia permitting the destruction and burning of the money that was the subject of the crime. In contrast, some of them advocated the prohibition of financial punishment absolutely, claiming consensus on that. In the third stage, two terms were distinguished among the jurists of the school: punishment in money, which corresponds to the financial fine in our days, and punishment in money, which corresponds to confiscation of money. It became clear that most scholars of the school prohibited punishment in money until the fatwa of Al-Barzili appeared in the ninth century AH permitting it, and permitting the imposition of financial fines when it is impossible to implement the legal limits. His speech was accepted by some jurists of Morocco and Mauritania in the later centuries, and their work was carried out according to it | ||
