| Abstract | ||
| حقوق الإنسان هي حقوق طبيعية لارتباطها الوثيق بطبيعة الإنسان؛ لأنها منبثقة من صميم ذاته. ومن ثم، فهي غير قابلة للتصرف، وليست منحة من سلطة معينة، إنما هي حقوق أساسية من حقوق البشر الطبيعية التي فطر الإنسان عليها منذ خلقه، ولما کان للفکر الإسلامي الأسبقية في إحقاق الحق قبل القوانين والمواثيق الدولية المعاصرة، فالفکر الإسلامي أولى من غيره من القوانين التي صاغها الإنسان من عقله وفکره الشخصي، فيأمرنا الله تعالى بالرجوع إلى الله والرسول عند التنازع، فجاء البحث ليکشف المنظار الإسلامي لتلک الحقوق، ومن ثم بيان المواثيق الدولية في ذلک. Abstract: Human rights are natural rights because they are closely linked to the nature of man, because they emanate from the very core. Hence, they are inalienable, not a grant from a particular authority, but basic human rights that human beings have violated since their creation. As Islamic thought takes precedence over the realization of truth before contemporary international laws and conventions, Islamic thought is superior to other laws The man formulated by his mind and personal thought, God ordered us to return to God and the Prophet when the conflict, the search came to reveal the Islamic perspective of those rights and then the statement of international covenants in it. | ||
