| Abstract | ||
| تناولات هذه الدراسة عنوان : " حقوق المسنين الاجتماعية في الفقه الإسلامي والمواثيق الدولية "يدور الحديث هنا حول موضوع حول فئة كبيرة في المجتمع ألا وهى الشيخ والشيخة أو المسنين، وهل لهم حقوق على هذا المجتمع الذى يعيشون فيه، بالطبع إن للمسن أو الشيخ الهرم مجموعة من الحقوق التي تثبت له لكونه أصبح مسن من هذه الحقوق التأمين الإجتماعى إضافة إلى التكافل، كذلك الاحترام والتوقير لشيخوخته، كذلك من أهم الحقوق لهم توفير المسكن المناسب، كذلك هل يعتبر تقديمهم لأمامة الصلاة هو من حقوقهم في الفقه الإسلامي أو لا، إضافة إلى ذلك فإن المواثيق الدولية قد أولت المسنين رعاية كاملة وذلك من باب تكريمهم لما قدموه للأجيال التي تأتى بعدهم . ومن هنا يتبين لنا أن الشريعة الإسلامية لم تترك أحد من بنى الإنسان إلا وأولته اهتماما وأنها ما جاءت إلا مراعيىة لمصالح العباد،كما أن المقارنة بين الحقوق التي أثبتتها الشريعة الإسلامية للمسنين والمواثيق الدولية تبين أن هناك فارق في الأسبقية في الثبوت، وكذا مصدر الحقوق، ومدى الآلزامية من عدمها،وبناء على هذا فالبحث يتكون من مقدمة وتمهيد ومباحثان وخاتمة، وقد اتبع الباحث في هذا البحث المنهج الاستقرائي التحليلي الذي يساعد على جمع و استقصاء ما يؤثر في الوسائل الشرعية للحد من أثار مشكلات قائمة المنقولات الزوجية. وتوصل الباحث إلى النتائج الآتية :- الشريعة الإسلامية مرنة وصالحة لكل زمان ومكان، كما أن الموائيق الدولية اعتمدت في كل معاهداتها على اثبات هذه الحقوق التي أقرتها الشريعة الإسلامية منذ أكثر من ألف أربعمائة عام. This study deals with the title: “The Social Rights of the Elderly in Islamic Jurisprudence and International Covenants.” The discussion here revolves around a topic about a large group in society, namely the sheikh and the sheikha or the elderly, and do they have rights over the society in which they live? Of course, the elderly or the aging sheikh has a group of The rights that are proven to him because he has become elderly. Among these rights are social insurance in addition to solidarity, as well as respect and reverence for his old age. Also, among the most important rights for them is the provision of appropriate housing. Likewise, is offering them to lead the prayer considered one of their rights in Islamic jurisprudence or not? In addition to that, the charters The International Organization has given the elderly full care, as a matter of honoring them for what they have provided for the generations that come after them. Hence, it becomes clear to us that the Islamic Sharia did not leave any of the human beings without paying attention to them, and that they only came to take into account the interests of the servants, just as the comparison between the rights established by the Islamic Sharia for the elderly and the international covenants shows that there is a difference in precedence in proving, as well as the source of rights, and the extent Is it compulsory or not, and based on this, the research consists of an introduction, a preface, two topics, and a conclusion. The researcher reached the following results: - The Islamic Sharia is flexible and valid for every time and place, just as the international conventions relied in all their treaties to prove these rights that were endorsed by the Islamic Sharia more than a thousand four hundred years ago. | ||
