| Abstract | ||
| إن الله تبارك وتعالى خلق الإنسان وجعل حياته تمر بأطوار مختلفة، وأحوال متباينة ما بين قوة وضعف، وصحة ومرض، وإقامة وترحال، وحركة وعجز، واختيار وإكراه، واستخلفه في الأرض، فتفاعل مع بيئته ومجتمعه، وتأثر بالزمان والمكان، وقد راعت الشريعة الإسلامية هذه الأمور في أحكامها التي عرفها الأصوليون بالنسب والإضافات تحقيقًا لمصالح العباد في عاجلهم وآجلهم؛ لهذا كانت أحكام الشريعة منها ما هو عام يتعلق بالمكلف في أحواله العادية، ويسمى بالعزيمة، ومنها ما هو استثنائي يتعلق بالمكلف في أحوال خاصة، ويسمى بالرخصة. ولما كانت أحكام الشريعة دائرة بين الأمرين، وكان فعل المكلف مترددًا بينهما كان من الضروري الوقوف على موجب العمل بكل من العزيمة أو الرخصة؛ إذ إنهما متساويان في أصل التكليف، وكذلك الوقوف على موجب ترجيح أحدهما على الآخر، وأولوية العمل به؛ بناءً على النسب والإضافات حيث إنه ما من عمل إلا وفيه مشقة، فحينما تكون المشقة المقترنة بالعمل عادية، كانت العزيمة، وإذا كانت غير عادية، كانت الرخصة؛ إذ الناس متفاوتون في تحمل ذلك، لاختلاف أحوالهم قوة وضعفًا؛ لذا كان المرجع في معيار ذلك والعمل به هو فقه النفس للمكلف، ونظر المجتهد، وقد بان هذا الأمر وانجلى خفاؤه من خلال ما قمت بعمله، وتعرض إليه في هذا البحث حتى يتجلى أساس الشريعة الذي قامت عليه وأصلها الذي تشيد به أركانها، وهو اليسر والتخفيف ورفع الحرج. God Almighty created man and made his life go through different phases, and conditions varying between strength and weakness, health and disease, residence and travel, movement and disability, choice and coercion, and his successor in the earth, so he interacted with his environment and society, and was affected by time and place, and Islamic law has taken into account these things in its provisions, which the fundamentalists defined by proportions and additions to achieve the interests of the people in their sooner and later; In special cases, it is called a license.
