Abstract
ترتب الصفقات العامة التزامات على عاتق صاحب المشروع او مفوضه ، وكذلك على صاحب الصفقة الذي تعهد بتنفيذ التزاماته ، كما أن الصفقة في مرحلة تنفيذها أو بعده بحاجة الى رقابة وذلك ضمانا لحسن تنفيذها وحماية للمال العام واستنادا لذلك أوكل المشرع مهمة الرقابة لأجهزة تقوم بها سواء كان ذلك كلجان يتم انشاؤها، أو أجهزة خارجية يوكل اليها المشرع مهمة الرقابة على الصفقات العامة وهذه الرقابة قد تكون قبلية أو بعدية، كما تهدف الى الحفاظ على الحقوق، وللرقابة آليات ووسائل تتمثل في ضمان مراقبة قانونية وانتظام جميع الأعمال ذات الأثر المالي ، كما تساهم في التأكد من تطبيق الأنظمة والإجراءات المتعلقة بالصفقة العامة ، والمساهمة في تعزيز الشفافية وتقديم حلول فعالة للمنافسة وكذلك استبعاد الأشخاص الطبيعيين والاعتباريين الذين انتهكوا لوائح الصفقات العامة, كما تظهر أهمية البحث في كونه يتناول الرقابة على الصفقات العامة في جمهورية تشاد. لذا يجيب البحث عن السؤال الاتي: ما الرقابة على الصفقات العامة في جمهورية تشاد؟ وما الرقابة القبلية على الصفقات العامة؟ ما الرقابة البعدية على الصفقات العامة؟ كما توصلت الدراسة الى عدة نتائج أهمها: أن سلطة الرقابة على الصفقات العامة من النظام العام تمارسها الإدارة وإن لم ينص عليها في العقد, وأن المشرع منح أجهزة الرقابة القبلية سلطة توقيع عقوبات تأديبية للمتعاملين معها في مجال الصفقات العامة وأنهيت الى توصيات أهمها: ضرورة إنشاء هيئة مستقلة للرقابة على المال العام وحمايته، والحد من الفساد بشتى أنواعه, وضرورة تزويد الجهات الرقابية بالوسائل اللازمة والممكنة للقيام بالمهام المنوطة بها. Abstract: Public procurements entail obligations on the owner of the project or his commissioner, as well as on the owner of the procurement, who pledged to implement his obligations, and the transaction at the stage of its implementation or after it needs to be monitored in order to ensure its proper implementation and protect public money and accordingly the legislator entrusted the task of control to organs carried out, whether as committees to be established, or external bodies entrusted by the legislator with the task of monitoring public procurements and this control may be before or after, as it aims to maintain On rights, the control has mechanisms and means to ensure legal control and regularity of all actions with financial impact, as well as contribute to ensuring the application of regulations and procedures related to the public procurement, and contribute to enhancing transparency and providing effective solutions to competition. As well as the exclusion of natural and legal persons who have violated the regulations of public procurement, the importance of the research also appears in the fact that it deals with the control of public procurements in the Republic of Chad. Therefore, the research answers the following question: What is the control of public procurements in the Republic of Chad? What is tribal control over public procurements? What is post-control of public procurements? The study also reached several results, the most important of which are: that the authority to control public procurements from the public order is exercised by the administration, even if not stipulated in the contract, and that the legislator granted the tribal control bodies the authority to impose disciplinary sanctions for those dealing with them in the field of public procurement. It concluded with recommendations, the most important of which are: the need to establish an independent body to control and protect public funds, reduce corruption of all kinds, and the need to provide the regulatory authorities with the necessary and possible means to carry out the tasks entrusted to them.
