| Abstract | ||
| للمجتهد في الإسلام منزلة رفيعة، فهو قائم مقام النبي e بوصفه وارثًا لعلم النبوة، ومبلغًا إياه إلى الناس، وبوصفه معلمًا ومرشدا للأمة. لذلك اهتم العلماء –رحمهم الله- بالشروط التي يُقبل بهها المجتهد اجتهاده ، لذلك أفردوا لها المباحث والمسائل في كتبهم ، وعددوها ، وشرحوها ، لكن منهم من شدد ببعض الشروط ، ومنهم من تساهل في بعضها ، فلم يكونوا على منهج واحد ، لذلك فإن مجمل ما ذكروه من شروط مرده إجمالًا إلى معرفة مصادر الشريعة ومقاصدها، وفهم أساليب اللغة العربية، وأن يكون المجتهد على درجة من الصلاح، تجعله يتحرى في اجتهاده، ويحرص على مطابقة شرع الله وتقديمه على هواه. The mujtahid has a high status in Islam, as he takes the place of the Prophet (peace and blessings of Allah be upon him) as an inheritor of the knowledge of prophecy, conveying it to the people, and as a teacher and guide for the nation. Therefore, scholars - may Allah have mercy on them - were concerned with the conditions under which the mujtahid's ijtihad is accepted, so they devoted discussions and issues to them in their books, enumerated them, and explained them, but some of them were strict with some of the conditions, and some of them were lenient with some of them, so they were not on one approach, so the generality of what they mentioned of conditions is generally due to knowledge of the sources of the Sharia and its objectives, and understanding the methods of the Arabic language, and that the mujtahid be at a level of righteousness that enables him to investigate his ijtihad, and be keen to conform to Allah's law and present it over his desires. | ||
